Evidence in the Holy Land Foundation re-trial now online

Oct 01, 2008

Kudos to the staff of U.S. District Judge Jorge Solis, the federal clerk's office and anyone else responsible for helping get the volumes of re-trial evidence online and available to the public. ( http://www.txnd.uscourts.gov/judges/hlf2.html ) Last year, Judge A. Joe Fish had the same open policy, and the trial evidence from both the prosecution and defense became an invaluable tool for researchers as well as the curious.

And for the cloak and dagger set out there, click on anything labeled "Ashqar Search." You'll notice that they aren't really documents at all, but rather pictures of documents.

That's because they weren't seized with traditional search warrants, but instead were the fruits of a covert op approved by the Clinton Administration in a massive investigation of Hamas in the U.S.

The day after Christmas in 1993, FBI agents entered the apartment of Abdelhaleem Ashqar, then a grad student in Oxford, Miss., and took pictures of a trove of documents outlining Hamas and Muslim Brotherhood activities in the U.S.

He was acquitted in a Chicago federal court for direct support of Hamas, but was ultimately convicted for withholding information from a grand jury.

The Ashqar documents are now being used as government evidence in the trial of the five Holy Land defendants, charged with funneling more than $12 million to Hamas.
